Graphic Design (s):

Creation include, but are not limited to business cards, brochures, posters, newsletters, pamphlets, flyers, reports, information packets, booklets, manuals, presentation folders, displays and charts, trade show, banner and signs, decals, any and all graphics designed or developed by Xelk Visual Communications.

Project Production Schedule – A written document, estimate, invoice, e-mail or fax outlining the timelines for design, layout, artwork, review times, changes, and printing, this document will be used as a contract agreement between Xelk and customer.

Charges: Xelk's Graphic Design/Development and Creation services are provide by hourly rate as especify on your estimate.

Description: This policy defines roles and responsibilities for customer and Xelk Visual Communications graphic design development and creation.

Purpose/Rationale: The purpose of this policy, associated procedures and the Xelk Visual Communications Graphic Design Guide are to ensure that:

• Clearly and effectively communicate information and rules about the specific topic to client
• Show Xelk Visual Communications commitment to professionalism and quality.

Applicability: This policy applies to all Xelk Visual Communications employees and contractors, and customers engaged in graphic design development, with Xelk Visual Communications

·         Ownership of Artwork:  Xelk have the rights to retain all the artwork. If the originals are requested by customer, an additional cost may be charged, in part to at least cover media costs and the time required to transfer the files to disk.

·         Ownership of Preliminary Designs: Xelk retains ownership of all preliminary design work, in the event the client cancels the project after provided some initial designs for approval. Client must return of preliminary designs, and an additional fees apply if the client fails to return the artwork upon cancellation.

copyright policy:

Upon payment in full, customer will be entitled to a final work product on a JPG format, if requested, a vector art  an additional fee apply. And a negotiable fees are available for copyright. Materials and preliminary files used in the creation of final artwork are excluded and remain the property of Xelk Visual Communications. Xelk Visual Communications will retain the right to represent work product for portfolio purposes, unless prohibited by confidentiality agreement.

COLORS GUARANTEE

Wide Format Digital Printing: Colors are guaranteed. Within the color spectrum of the CMYK or Pantone color matches of each individual project. If color a variation occurs, we will confirm with the costumer the specific issue for each order.

Laser Jet Printing: Colors are guaranteed. Within the color spectrum of the CMYK or Pantone color matches of each individual project. If color a variation occurs, we will confirm with the costumer the specific issue for each order.

Reprographic Blue Prints: Tones are guaranteed. within the PDF file format and a minimal of 150 dpi or the condition of your hard copy.

Embroidery Stitching: Color Guarantee. The accuracy of stitching color matching is a 5% to 10% variation from CMYK color matching. By placing an order with us, you agree to this limitation. Xelk Visual Communications accepts no responsibility for color variations between submitted files and the final product. Under no circumstances will refunds or restitching will be honored for color variations that have occur during the stitching process, having been previously clarified and approved.

Silk-Screen Printing: Color guarantee. The accuracy of color reproduction is not guaranteed, and by placing an order with us, you agree to this limitation. Xelk Visual Communications accepts no responsibility for color variations between submitted files and the final printed product. Under no circumstances will refunds or reprints be honored for color variations that have occur during the printing process, having been previously clarified and approved.

CUTTING & SIZE LIMITATIONS
All Jobs are printed at the size of the order. Slight inside cuts can occur to avoid excess from the adjacent job. We accept no responsibility for size variations below or above 1/16" to 1/8". Cuts also slide up, down, left, or right 1/16" to 1/8" in either direction. Therefore, we strongly recommend that you do not use borders on your print job. If your design uses borders, Xelk Visual Communications cannot be responsible for differences between the border and the cut. Under no circumstances will, refunds or reprints, be honored, for cutting or size variations that have occurred during the printing process within these specifications.

QUANTITY VARIATIONS
All jobs are printed at the quantity of the order, with paper project variation up to 10%. Exception being, Wide Format, Reprographics Blue Prints, Silk-Screen, Embroidery and Transfer orders will be printed exactly to the amount specified in your order.

COPY & DESIGN ERRORS
Most of the time your job arrives at Xelk Visual Communications and are ready to print, all edits should be finalized the copy carefully proof read and all design issues should be completed. Xelk Visual Communications does not take responsibility, for any copy or design errors committed on your part, once art is submitted and approved for print. Under no circumstances, refunds or reprints will be honored, for an error in the file submitted.

NATIONWIDE SHIPPING
The Costumer will be able to choose air or ground shipping, with UPS or U.S. Post Office. Xelk Visual Communications will not be responsible for shipping delays or lost shipments caused by third party shipping companies. Under no circumstances will, refunds or reprints, be honored, for a shipping delay or lost shipment.

CANCELLATION & REFUND POLICY
Once your job has been confirmed, paid and printed, there is absolutely no way to cancel the order. Under no circumstances are, refunds honored. There are absolutely no exceptions.

TURNAROUND TIMES//RUSH FEE
Turnaround times are estimates only. Please keep in mind there are several different things that can occur with the process that are out of our control. The turnaround times we give are base on actual experience of jobs we have done in the past and are NOT guarantees. Under no circumstances are, refunds honored for a delay in our estimated turnaround time. Rush fee will apply for all orders that under client request needs to be delivered with in 48 hours.

Indemnification
The customer will indemnify and hold harmless the printer, Xelk Visual Communications, from any and all loss, cost expense, and damages on any and all manner of claims, demands, actions and proceeding that may be instituted against the printer on the grounds alleging that said printing violates any copyright or any proprietary right of any person. You certify that you own the rights to use the image(s) being reproduce on your order.

Rules for Online Conduct
Use of these services, you agree that you will not attempt to undermine the integrity of the Xelk Visual Communications, web site.

Trademarks
Trademarks may appear on the Xelk Visual Communications, web site are trademarks of their respective owners.

Right to Subcontract
Xelk Visual Communications shall have the right to assign any portion of the work required to another contractor

Sample Use
Xelk Visual Communications may use your product for samples or advertising purposes.

CUSTOMER AGREES THAT USE OF THE SERVICE IS ENTIRELY AT CUSTOMER'S OWN RISK. SERVICES ARE PROVIDED 'AS IS,' WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE SERVICE, INCLUDING WITHOUT LIMITATION THE SOFTWARE LICENSED TO THE CUSTOMER AND THE RESULTS OBTAINED THROUGH THE SERVICE. SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: 1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES; AND 2) ANY WARRANTIES OF TITLE OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

CUSTOMER SPECIFICALLY ACKNOWLEDGES THE SERVICE IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER CUSTOMERS OR THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH CUSTOMER.
NEITHER THE SERVICE NOR ANY OF ITS AGENTS, AFFILIATES OR CONTENT PROVIDERS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE OR INABILITY TO GAIN ACCESS TO OR USE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY. CUSTOMER HEREBY ACKNOWLEDGES THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT ON THE SERVICE.
